While the court was extremely divided on this case, the opinion of the court (given by Justice Powell) concurred with that of the Supreme Court of California saying that the quota system practiced was indeed unconstitutional. However, the supreme court also ruled that affirmative action programs are constitutional and may be used in the admissions process.
